Abstract

Global economies and societies demand the private sector to take on a pivotal role in the fight against climate change and in the quest for climate justice. Undertakings have been called to join the efforts of public players and regulators in the creation and preservation of a safe and just place for people and the planet, now and in the future, within planetary boundaries. The financial risk of unsustainable business models is among the main concerns of executives of commercial companies around the globe, joined by its immediate corollaries of being excluded from value chains and targeted consumers’ boycott campaigns.

While (arguably) many have maintained that the Covid-19 pandemic has put a pause to the debate on corporate sustainability, the war in Ukraine and the energy crisis have undeniably brought back to the top of boards’ agendas the question of how to maximize positive externalities while reducing the environmental impact of an undertaking.

Well beyond regulatory concerns, undertakings nowadays widely rely on their (internal and external) legal advisors to navigate the storm of ESG factors impacting their operations. The legal function has thus gained an increasingly strategic role in the definition of policies, market strategies and business models, in which interdisciplinarity and soft skills are essential components of a lawyer’s toolbox, almost as much as a thorough knowledge of the law.

During this Lunch Seminar, we will discuss with a corporate lawyer why and how the role of the legal advisor is changing and which challenges and opportunities the legal profession is currently facing when it comes to corporate sustainability.

Biography

Dino Serafini is a corporate lawyer, enrolled in the Luxembourg and Rome (Italy) Bar Associations. He is a member of the Corporate Transactional Team at Arendt & Medernach in Luxembourg, where he also advises on Corporate Sustainability matters.

After serving as Sustainability Officer of the International Association of Young Lawyers (AIJA), Dino is now the Chair of the Sustainability Committee of such Association.

Dino holds a PhD from the University of Naples – Federico II, where he graduated with honours, defending a thesis on Social Enterprises and Third Sector Entities.
